Global Connections International Exchange

Cheng Yoke Ping from the Capital Markets / Mergers & Acquisitions / Indonesia Practice was one of the presenters at HSBC's fourth Global Connections International Exchange which was held in Singapore from 26 February to 1 March 2013.

Singapore is a strategic location for businesses to establish their regional operations. In her presentation on "Corporate Structures to Support Regional Operations", Yoke Ping discussed the various benefits of setting up a Singapore holding company including the regional and international headquarters programme and the various free trade agreements and agreements for the avoidance of double taxation to which Singapore is a party.  She also touched on things to consider when doing business in the region including foreign ownership restrictions.

The event, attended by global business leaders and experts from around the world, was organised by HSBC.

2nd ICCA In-House Counsel Summit

Prakash Pillai, the Head of the firm's South Asia Practice and a Partner in the firm's International Arbitration Practice, was the chairperson in one of the sessions in the 2nd ICCA In-House Counsel Summit held in New Delhi on 22-23 February 2013.

Prakash chaired the session on "Current Issues in Arbitration" wherein the speakers spoke on a range of issues such as choice of venue, regional diversification of arbitration, interim relief and emergency arbitrators and expert evidence in international arbitrations.

The event was organised by the Indian Corporate Counsel Association ("ICCA").

Litigation Conference – Present Challenges, Future Prospects

Lee Eng Beng SC, Head of Disputes Practices Francis Xavier SC and Paul Tan from the Appeals & Issues Practice were the chairpersons and panelist in a conference titled "Law Society's Litigation Conference – Present Challenges, Future Prospects" held on 31 January – 1 February 2013.

Eng Beng chaired the session on "Appeals & Review" wherein the members of the panel shared invaluable insights into the appellate and review process. These include strategies on how to get the Tribunal to look at an advocate's case from his client's point of view.  The panelists also discussed current issues and trends in judicial review.

In the session on "Due Process", Francis considered whether the transplantation of an inquisitorial approach (only in terms of procedure) in certain types of cases in Singapore would affect the continued observance of due process. The answer appears to be "no". The common and civil law systems do differ greatly in their approach to fundamental matters such as the function of pleadings, the role of the judge and counsel, and the treatment of documentary and oral evidence. Francis highlighted that an enlightened approach was to recognise that both systems of law have their own flaws as well as key advantages. Thus, when appropriately transplanted here, the advantages of the inquisitorial system can be harnessed (with due customisation) to our advantage in the appropriate types of disputes.

Paul was the co-chairperson in the session on "Access to Courts, Access to Justice", which tackled the unique challenges faced by the practitioners at different levels concerning issues of access to justice. Recognising that one dispute resolution process could not address different categories of cases and different users of the legal system, the panel stressed the need for tailored solutions rather than broad brush measures to enhance access to justice.

The Conference was organised by the Law Society of Singapore.
