ASEAN Economic Community Portal

Ahead of the launch of the ASEAN Economic Community ("AEC") in December this year, businesses looking to tap the opportunities presented by the integrated markets of the AEC can now get help a click away. Rajah & Tann Asia, United Overseas Bank and RSM Chio Lim Stone Forest have teamed up to launch "Business in ASEAN", a portal that provides companies with a single platform that helps businesses navigate the complexities of setting up operations in ASEAN.

By tapping into the professional knowledge and resources of the three organisations through this portal, small- and medium-sized enterprises across the 10-member economic grouping can equip themselves with the tools and know-how to navigate ASEAN's business landscape. Of particular interest to businesses is the "Ask a Question" feature of the portal which enables companies to pose questions to the three organisations which have an extensive network in the region.

The portal was unveiled together with a book titled "Doing Business in ASEAN" at ASEAN-focused conference held on 20 May 2015. The Conference was organised by the Singapore Business Federation, with Rajah & Tann Asia, United Overseas Bank and RSM Chio Lim Stone Forest as Founding Conference Partners. "Grabbing with Both Hands"

ASIAN-MENA COUNSEL featured in its Volume 2 Issue 10, 2015 an article titled "Grabbing woth Both Hands",  which includes quotes from Rajah & Tann (Thailand)'s Surasak Vajasit and Christopher & Lee Ong's Ong Chee Kwan. The article looks at the direction of dispute resolution in Singapore, Hong Kong, Thailand and Malaysia from the viewpoint of dispute resolution practitioners. Surasak sees parties in the ASEAN looking towards Singapore as a neutral place for arbitration of disputes. Surasak is of the view that there is still insufficient support in Thai arbitration in so far as qualified arbitrators are concerned, and a lack of clear precedents in terms of enforcement. For this reason, he opines that Thai companies will look to Singapore as a desirable and justifiable venue for their arbitration needs.

Over in Malaysia, Chee Kwan observes that the country is stepping up in terms of both litigation and arbitration. With the advent of the ASEAN Economic Community, he states the judiciary is enhancing its system to instill confidence for the investors that their grievances will be adjudicated upon fairly and expeditiously. In the arbitration front, he stresses that Kuala Lumpur International Arbitration Centre and the judiciary are both supportive of each other.

Malaysia: A New Way of Raising Capital, Investing

Edwin Lee Yong Cieh from Christopher & Lee Ong wrote an article titled "A new way of raising capital, investing" in the 27 February 2015 issue of The Edge, a Malaysian financial daily of general circulation. The article highlights the new guidelines released by the Securities Commission of Malaysia ("SC") on 10 February 2015 to facilitate equity crowdfunding. The release of these SC Guidelines is a progressive milestone by the government of Malaysia towards creating a thriving entrepreneurial ecosystem.

Malaysia: MSC Malaysia Status for Technology Startups

Edwin Lee Yong Cieh from Christopher & Lee Ong wrote an article on "MSC Malaysia Status for Technology Startups" in the June 2015 issue of the IT magazine, Chip Malaysia. The article highlights a new incentive programme by Multimedia Super Corridor ("MSC") Malaysia catering specifically for tech startups to obtain MSC Malaysia status without being tied to the location requirements, known as a Tier-3 company status. It is hoped that with this new incentive programme for tech startups, it will take aspiring tech startups to the next level of growth to become regional and global players.

Malaysia: The Extent of an Insurer's Liability in a Third Party Claim

Nur Ayuni binti Ab Rahim from Christopher & Lee Ong wrote an article titled "The Extent of an Insurer's Liability in a Third Party Claim" in the Legally Speaking column of The Sun, a Malaysian newspaper of general circulation. The article highlights the recent Court of Appeal case of Pacific & Orient Insurance Co. Bhd. v. Kamacheh a/p Karuppen decided on 6 March 2015, and addressed the issue of whether an Insurer is liable to pay a third party if an insured vehicle was used for illegal purposes at the time of a motor vehicle accident.
