Change of Name of Practice Group – Shipping and International Trade

We are pleased to announce that with effect from 1 March 2015, our Admiralty & Shipping practice group will be re-named Shipping and International Trade.

This name change is timely as it reflects the Group's increasingly significant practice in international trade and commodities both on the contentious and non-contentious fronts, which complements its established shipping practice.  The expertise within the group encompasses all aspects of commodity work from trade finance, international sanctions and contract documentation to representing clients in complex commodity disputes in litigation and arbitration before the SIAC, SCMA, ICC, CIETAC, and various commodity trade tribunals. The group serves a wide range of clientele including producers, traders, banks, oil and energy majors as well as end users.

Client Seminars: Recent Trends in Anti-Corruption Laws and Competition Laws

The Japan Desk of the firm recently organised two seminars for its existing clients and potential clients.  Hamidul Haq, the Head of the firm's White-Collar Crime and Shuhei Otsuka from the Japan Desk gave a talk on "Recent Trends in Anti-Corruption Laws in Singapore and ASEAN" on 26 and 27 February 2015. This was a seminar on the latest developments in anti-corruption laws in the region, with focus on corruption cases in Singapore last year.

Earlier on 3 February 2015, Kala Anandarajah, the head of the firm's Competition & Antitrust and Trade Practice, and Shuhei Otsuka from the Japan Desk conducted a seminar titled "Recent Trends in Competition Laws in Singapore and ASEAN". In light of the recent Competition Commission of Singapore's actions on international cartels in which Japanese companies were involved, Kala and Shuhei discussed the recent trends in competition law in the region.

In each of the seminar, the speakers provided practical points that Japanese companies should be aware of when complying with the relevant laws as they expand into the region.

Client Seminar: Competition & Antitrust Law – Running from Law and Chasing Twisters

Kala AnandarajahDominique Lombardi and Tanya Tang from the Competition & Antitrust and Trade Practice of the firm conducted a client seminar titled "Competition & Antitrust Law – Running from Lava and Chasing Twisters" on 27 January 2015. The speakers touched on lessons learnt in 2014 in competition law front, and provided their take on what is likely to come up in 2015 on heightened enforcement and needs to notifications and leniencies. While the focus of the talk was on Singapore, the speakers also provided insights into ASEAN and the upcoming ASEAN Economic Community. The key areas discussed included: (i) behavioural and structural commitments of mergers in various ASEAN countries and possibility of Section 4 Reviews in Malaysia: (ii) cartel enforcement – what direction is it heading in across ASEAN; (iii) digital economy, online marketplaces and how competition authorities are responding; (iv) non-traditional industries subjected to investigations globally and what will come to ASEAN; and (v) importance of economics in competition analysis.

Recent Developments on Insurers' Rights of Subrogation

Rajah & Tann Singapore LLP and the Insurance Law Association, Singapore ("ILAS") co-organised a client seminar titled "Recent Developments on Insurers' Rights of Subrogation" on 6 January 2015. An insurer's right of subrogation is an important aspect of any insurance company's operations. The session, conducted by Jeffrey Gruder QC, examined the background of this important doctrine with a focus on recent developments in insurance law including the case of the "Ocean Victory" which he argued in the English Court of Appeal in October 2014.

Simon Goh, the Head of the firm's Insurance and Reinsurance Practice, and Elaine Tay, also from the same Practice, are ILAS' President and Honorary Auditor, respectively.

Indonesia: AHP Partners Represented Indonesia at 62nd Session of UNCITRAL Working Group II

Along with two other Indonesian lawyers, Assegaf Hamzah & Partners litigation partner Ahmad Maulana traveled to New York in 2-6 February 2015 at the request of the Ministry of Foreign Affairs to represent Indonesia at the 62nd Session of UNCITRAL Working Group II at the UN Headquarters in New York City. The meeting's agenda was to discuss a proposal from the United States to create an enforcement basis for settlement agreements arising out of international commercial conciliation / mediation processes. The meeting also included a discussion of the revision of the UNCITRAL notes on organising arbitration proceedings. No conclusions or decisions were arrived at during the meeting, but a number of recommendations were made to the UNCITRAL Secretariat.

Cambodia: R&T Sok & Heng Law Office Managing Partner Invited to Executive Breakfast with the Minister of Commerce

On 29 January 2015, the Managing Partner of R&T Sok & Heng, Heng Chhay, was invited to join the Executive Breakfast with the Senior Minister, Minister of Commerce of the Kingdom of Cambodia, on the Improvement of Cambodia's Business Environment.

During the session, each participant was allowed to raise his concerns in relation to Cambodia's business environment. The Managing Partner and other lawyers present raised the difficulties they face in registering businesses, including tax registration. They then provided recommendations to address those issues, with the end in view of facilitating investment in the country.

The Minister of Commerce as well as the Director General of General Department of Customs and Excises had indicated that they would look into these concerns and draw up solutions to address the issues raised.

The event was hosted by the World Bank supported by Emerging Markets Consulting (EMC). Lawyers and executives from various well-known firms and companies attended the event.
