Client Seminar: A Wave of Change After the Court of Appeal's Decision in CIT v BBO: Are All Gains from the Disposal of Long-Term Investments by Insurance Companies not Taxable?

Vikna Rajah from the firm's Tax Practice was the speaker at a client seminar titled "A Wave of Change after the Court of Appeal's Decision in CIT v BBO: Are All Gains from the Disposal of Long-Term Investments by Insurance Companies not Taxable?" conducted on 21 November 2014.

For years, the Internal Revenue Authority of Singapore ("IRAS") would subject virtually all gains from an insurance companies from the disposal of investments to tax under section 10(1)(a) of the Income Tax Act. However, in the landmark decision of CIT v  BBO [2014] SGCA 10, the first local decision to deal with the taxability of investment gains by insurance companies, the Court of Appeal clarified that insurance companies could hold capital assets, the gains on which would not be taxable. Vikna discussed the factors to consider in determining what constitutes capital assets of an insurance company, and offered insights on whether IRAS may ring-fence this decision and limit its applicability to specific circumstances.

Client Seminar: Implied Duty of Mutual Trust and Confidence Between Employer and Employee in Singapore? Potential Pitfalls and Risks for Employers

Lai Yew Fei, Jonathan Yuen and Luo Qinghui from the firm's Commercial Litigation Practice were the speakers at a client seminar titled "Implied Duty of Mutual Trust and Confidence Between Employer and Employee in Singapore? Potential Pitfalls and Risks for Employers" held on 11 November 2014.

In recent times, the Singapore courts have recognised the existence of an implied duty of mutual trust and confidence in the employer-employee relationship, and also clarified the extent of damages that can be claimed for the breach of such an implied duty. As the courts have held that breach of this implied duty can constitute a repudiatory and fundamental breach of the employment relationship, the seminar explored the scope of this seemingly amorphous concept of the implied duty of mutual trust and confidence, the potential risk and exposure that employers face. The speakers also offered practical solutions to mitigate risls posed by this implied duty.

Steve Tan Guests at Channel News Asia's "Between the Lines"

Steve Tan from the Technology, Media & Telecoms Practice was one of the guest resource persons in Channel News Asia's current affairs programme "Between the Lines". The talk show dealt with the privacy concept called the Right to be Forgotten, tackled in a recent ruling of the European Court of Justice ("ECJ"). In this landmark decision, the ECJ held that an individual has the right to request search engine operators to remove the link between search results and a webpage that contains information which the individual deems should be "forgotten". 

There has been a discussion on this in Asia, when a Tokyo District Court appeared to give a provisional ruling recognising a right to be forgotten. Steve discussed the prospect of the ECJ ruling extending to the Asia Pacific, including the impact of such ruling on the Singapore legal landscape.

Yu Zheng Presents Singapore Rajah & Tnn Scholarship at Dalian Maritime University's Outstanding Students Awards Ceremony

Yu Zheng from Rajah & Tann Singapore LLP Shanghai Representative Office was one of the honoured guests at Dalian Maritime University in its Outstanding Students Awards Ceremony held on 29 November 2014. He represented Rajah & Tann Singapore LLP in awarding the Singapore Rajah & Tann Scholarship to five deserving students.

The Scholarship is awarded on a yearly basis to students who are selected based on their academic performance and character.

Rajah & Tann Participates in Singapore SGX Bull Charge Charity Run

Rajah & Tann Singapore participated as an institutional sponsor at the Singapore Exchange (SGX) Bull Charge charity run held on 14 November 2014. Runners from the financial industry and SGX-listed companies raced along the streets of the Central Business District to raise funds for the charity run beneficiaries.

Rajah & Tann Singapore sponsored the goodie bags for the event, as well as the Bull Charge Lollipop Wall which was installed at Vivo City to coincide with the charity run.

Myanmar Thanksgiving Dinner

Rajah & Tann NK Legal Myanmar Company Limited held a Thanksgiving Dinner on 4 November 2014 at the oldest swimming club in Myanmar, Kokine Swimming Club, of which Managing Partner U Nyein Kyaw is a trustee. The firm's Myanmar Practice co-heads Chester Toh and Jainil Bhandari, the head of Rajah & Tann Singapore's Energy & Resources Practice, Marae Ciantar, as well as Andrew CL Ong, were present.
