Client Seminar: Economics in Competition Law: Going beyond A B C to 1 2 3

Tanya Tang from the Competition & Antitrust and Trade Practice spoke at a client seminar titled "Economics in Competition Law: Going Beyond A B C to 1 2 3" held on 31 October 2014.

Tanya, together with our guest economist speaker from London, Dr Adrian Majumdar, discussed competition developments with an economic twist – from the calculation of antitrust damages in the EU (with implications for jurisdictions in this region that have rights of private action) to the assessment of net economic benefits in airline alliances and other competition cases.

Client Seminar: Managing Regulatory Risks in Asia - Are Companies Fighting a Losing Battle?

Chester Toh, the head of the firm's Integrated Regulatory Practice, was a speaker at a seminar titled "Managing Regulatory Risks in Asia - Are Companies Fighting a Losing Battle?" conducted on 24 October 2014. The roundtable was organised by the Association of Corporate Counsel.

The talk was followed by a roundtable discussion of various compliance and regulatory experiences by the participants, comprising mainly General Counsel and regional legal counsel.

Client Seminar: SGX Consultations on: (1) Introduction of Minimum Trading Price and Codification of Regulatory Tools; and (2) Reinforcing the SGX Listings and Enforcement Framework

Cheng Yoke Ping from the Mergers & Acquisition Practice spoke at a client seminar titled "SGX Consultations on: (1) Introduction of Minimum Trading Price and Codification of Regulatory Tools; (2) Reinforcing the SGX Listings and Enforcement Framework" held on 15 October 2014.

The seminar provided participants with an overview of upcoming regulatory changes proposed by the Singapore Exchange (SGX) in two recently-issued consultation papers. The proposed changes include the introduction of a minimum trading price, changes to the watch-list framework, refinements to certain notification requirements currently in place, and an enhanced listing and enforcement framework. The speakers also discussed the practical impact of these changes on listed companies.

Client Seminar: Losing Your Rights: Problems with Waiver and Estoppel

Rajah & Tann Singapore LLP and Insurance Law Association, Singapore ("ILAS") co-organised a talk on "Losing Your Rights: Problems with Waiver and Estoppel" on 9 October 2014.

Waiver and estoppel have been sources of repeated legal and practical difficulties for commercial parties, including insurers. Even the very definition of waiver and estoppel is fraught with difficulty. Until recently, the two doctrines were used interchangeably and with a great deal of confusion. This talk by Mr Sean Wilken QC sought to address the difficulties in this area with a focus on the insurance industry.

Simon Goh, the Head of the Firm's Insurance and Reinsurance Practice, is the incumbent President of ILAS, whose members consist of lawyers, insurers, insurance brokers, loss adjusters, insurance accountants and others who have an interest in insurance law. ILAS represents the Singapore Chapter of the Association Internationale de Droit des Assurances (AIDA), which is The International Insurance Law Association.

Client Seminar: Seizing the Day: Intellectual Property Enforcement

Nicholas Lauw from the Intellectual Property Practice was the speaker at a client seminar titled "Seizing the Day: Intellectual Property Enforcement" conducted on 2 October 2014.

This talk provided an overview of the various ways in which companies can enforce their IP rights against infringers so they may be able to choose a means of protection that fits best with their business.

Client Seminar: Roadmap to Foreign Investment in Myanmar

Chester Toh, the co-head of the firm's Myanmar Practice, and Paul Tan from the International Arbitration Practice were the speakers at a client seminar titled "Roadmap to Foreign Investment in Myanmar – Will Fortune Favour the Brave?" held on 29 September 2014. 

Chester provided an overview of Myanmar's foreign investment regime, characterised by the country's opening up to foreign participation in more sectors with some exceptions. He also identified key issues that foreign investors would likely face when investing in Myanmar, such as foreign ownership restrictions, company structure and financing. He then shared his insights on Myanmar's foreign investment regime and its implications for foreign investors. Finally, he offered practical tips for getting a deal through, including conducting due diligence exercise and being aware of cultural sensitivities and local customs. 

Paul, in his session on "International Arbitration", highlighted the value of international commercial arbitrations in settling disputes in cross-border commercial relations. This is especially important with the recent accession of Myanmar to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards that allows foreign investors to agree to refer disputes to offshore arbitration. Paul also provided the latest updates on Myanmar's investment treaties.

The seminar was co-organised by Danish Business Association Singapore (DABS).
