PDPA - A Game Changer for Telemarketing

Benjamin Cheong from the Technology Media & Telecommunications Practice wrote an article titled "This Time, It's Personal - The Personal Data Protection Act will change the way that SMEs conduct telemarketing" that was published in the July/August 2013 issue of The SME Magazine, a bi-monthly publication produced by The Business Times.

The article alerts small and medium enterprises ("SMEs") engaged in telemarketing services of the duties and responsibilities required of them under the Singapore Personal Data Protection Act ("PDPA").  The PDPA, which came into effect on 2 January 2013, contains various rules pertaining to the collection, use, disclosure and care of personal data. A contravention of the "Do Not Call" provisions of the PDPA is a criminal offence.

The law will most certainly impact the way SMEs carry out their marketing activities, given the PDPA's provision for the establishment of a national Do Not Call ("DNC") Registry. To begin on 2 January 2014, the DNC Registry allows individuals, by registering their Singapore telephone numbers, to opt out of receiving marketing calls, text messages and faxes from organisations.

Benjamin suggested that telemarketing SMEs come up with a robust internal policy that complies with the PDPA. Some measures were proposed to be carried out, such as: (i) obtaining clear written consent from customers who wish to receive marketing messages from them; (ii) appointing a data protection officer to deal with data protection issues; and (iii) conducting targeted marketing.
