Malaysia has joined numerous other ASEAN as well as global countries in introducing Competition Laws. Passed on 22 April 2010, the Competition Act and the Competition Commission Act (the ‘Laws’) will come into force in 2011. However, drawing from the examples of other jurisdictions when similar Laws were introduced, businesses in Malaysia must use this interim period to gain an understanding of how the Laws could impact them. It is important to note that a prohibited activity which is continuing after the coming into force of the Laws will be caught. This was most recently confirmed by a High Court in one of the Asian countries.
